Rule 1	4 counts	Violation of any law or ordinance. Count 1 On or about December 12, 2010, at approximately 5:00 a.m., in the vicinity of 7138 W. 56th Street in Chicago, Illinois, Officer Rodriguez was the driver of a vehicle involved in a motor vehicle accident and failed to remain at the scene of the accident in violation of 625 ILCS 5/11-402, thereby violating any law or ordinance. Count 2 On or about December 12, 2010, at approximately 5:00 a.m., in the vicinity of 7138 W. 56th Street in Chicago, Illinois, Officer Rodriguez was the driver of a vehicle involved in a motor vehicle accident resulting in damage to a vehicle and failed to give information and/or render aid in violation of 625 ILCS 5/11-403, thereby violating any law or ordinance. Count 3 On or about December 12, 2010, at approximately 5:00 a.m., in the vicinity of 7138 W. 56th Street in Chicago, Illinois, Officer Rodriguez caused bodily harm to and/or endangered the safety of David Grijalva, in violation of 720 ILCS 5/12-5, when she fled the scene of a motor vehicle accident, thereby violating any law or ordinance. Count 4 On or about December 12, 2010, while off duty, Officer Rodriguez was the driver of a vehicle involved in a motor vehicle accident in the vicinity of 7138 W. 56th street at approximately 5:00 a.m. and failed to give notice of the accident by the fastest available means of communication to the local police department, in violation of 625 ILCS 5/11-407, thereby violating any law or ordinance.

Count 4 On or about June 28, 2012, Officer Rodriguez was found guilty in the Circuit Court of Cook County, Illinois, of violating 720 ILCS 5/12-5 (Reckless conduct), thereby impeding the Department's efforts to achieve its policy and goals or bringing discredit uponthe Department.

Count 2: On or about December 12, 2010, at approximately 5:00 a.m., in the vicinity of 7138 W. 56th Street in Chicago, Illinois, Officer Rodriguez was the driver of a vehicle involved in a motor vehicle accident resulting in damage to a vehicle and failed to give information and/or render aid in violation of 625 ILCS 5/11-403, thereby violating any law or ordinance.
Count 3: On or about December 12, 2010, at approximately 5:00 a.m., in the vicinity of 7138 W. 56th Street in Chicago, Illinois, Officer Rodriguez caused bodily harm to and/or endangered the safety of David Grijalva, in violation of 720 ILCS 5/12-5, when she fled the scene of a motor vehicle accident, thereby violating any law or ordinance.
Count 4: On or about December 12, 2010, while off duty, Officer Rodriguez was the driver of a vehicle involved in a motor vehicle accident in the vicinity of 7138 W. 56th street at approximately 5:00 a.m. and failed to give notice of the accident by the fastest available means of communication to the local police department, in violation of 625 ILCS 5/11-407, thereby violating any law or ordinance.

Count 2: On or about December 12, 2010, at approximately 5:00 a.m., in the vicinity of 7138 W. 56th Street in Chicago, Illinois, Officer Rodriguez caused bodily harm to and/or endangered the safety of David Grijalva when she fled the scene of a motor vehicle accident, thereby impeding the Department's efforts to achieve its policy and goals or bringing discredit upon the Department.
Count 3: On or about December 12, 2010, while off duty, Officer Rodriguez was the driver of a vehicle involved in a motor vehicle accident in the vicinity of 7138 W. 56th Street at approximately 5:00 a.m. and failed to give notice of the accident by the fastest available means of communication to the local police department, thereby impeding the Department's efforts to achieve its policy and goals or bringing discredit upon the Department.
Count 4: On or about June 28, 2012, Officer Rodriguez was found guilty in the Circuit Court of Cook County, Illinois, of violating 720 ILCS 5/12-5 (Reckless conduct), thereby impeding the Department's efforts to achieve its policy and goals or bringing discredit uponthe Department.

On May 28, 2014, the Superintendent of Police filed with the Police Board of the City of Chicago charges against Police Officer Venus Rodriguez, Star No. 12474 (hereinafter referred to as “Respondent”), recommending that the Respondent be suspended from the Chicago Police Department for a period of forty-five (45) days for violating several Rules of Conduct.

On June 17, 2014, the Superintendent moved to withdraw the charges against the Respondent without prejudice because prior to the filing of charges the Respondent elected to file a grievance pursuant to Section 9.6.B. of the Agreement between the Fraternal Order of Police Lodge No. 7 and the City of Chicago. The Police Board has considered the Superintendent’s motion.

IT IS HEREBY ORDERED that the Superintendent’s motion is granted.
