Count 1 Guilty On or around the date of March 15, 2017 at approximately 1:56 A.M., while on duty at a Mini-Mart located at the address of 3759 W. Chicago Avenue in Chicago, Illinois, Police Officer Chavez A Siler, while attempting to place Charles Whitehead under arrest, repeatedly stuck Whitehead on his face and/or with his firearms and/or aimed his firearm directly at and against Whiteheads's head after Whitehead had already been disarmed. Whitehead did not kick, punch, or physically attack Officer Siler or Office Michael Benamon. Even after Whitehead was on the ground, Officer Siler still continued to strike Whitehead on the face and/or head with a firearm, and/or pointed a firearm against his head, and/or asked assisting officers to tase Whitehead in the face.
Rule 6	1 count	Disobedience of an order or directive, whether written or oral. Count 1 Guilty On or around the date of March 15, 2017 at approximately 1:56 A.M., while on duty at a Mini-Mart located at the address of 3759 W. Chicago Avenue in Chicago, Illinois, Police Officer Chavez A Siler, while attempting to place Charles Whitehead under arrest, repeatedly stuck Whitehead on his face and/or with his firearms and/or aimed his firearm directly at and against Whiteheads's head after Whitehead had already been disarmed. Whitehead did not kick, punch, or physically attack Officer Siler or Office Michael Benamon. Even after Whitehead was on the ground, Officer Siler still continued to strike Whitehead on the face and/or head with a firearm, and/or pointed a firearm against his head, and/or asked assisting officers to tase Whitehead in the face.

Chicago Avenue in Chicago, Illinois, Police Officer Chavez A Siler, while attempting to place Charles Whitehead under arrest, repeatedly stuck Whitehead on his face and/or with his firearms and/or aimed his firearm directly at and against Whiteheads's head after Whitehead had already been disarmed. Count 1 Guilty On or around the date of March 15, 2017 at approximately 1:56 A.M., while on duty at a Mini-Mart located at the address of 3759 W. Chicago Avenue in Chicago, Illinois, Police Officer Chavez A Siler, while attempting to place Charles Whitehead under arrest, repeatedly stuck Whitehead on his face and/or with his firearms and/or aimed his firearm directly at and against Whiteheads's head after Whitehead had already been disarmed. Count 1 Guilty On or around the date of March 15, 2017 at approximately 1:56 A.M., while on duty at a Mini-Mart located at the address of 3759 W. Chicago Avenue in Chicago, Illinois, Police Officer Chavez A Siler, while attempting to place Charles Whitehead under arrest, repeatedly stuck Whitehead on his face and/or with his firearms and/or aimed his firearm directly at and against Whiteheads's head after Whitehead had already been disarmed. Whitehead did not kick, punch, or physically attack Officer Siler or Office Michael Benamon. It was ordered that Police Officer Chavez Siler, Star No. 7068, has been found guilty and is hereby suspended from his position as a police officer with the Department of Police and from the services of the City of Chicago, for a period of six months from the dates of March 24th 2022 to, and including, September 23rd 2022. It is further ordered that Officer Siler be restored to his position as a police officer and to the services of the City of Chicago, with all the right and benefits that comes with the job titled, effective September 24th 2022.
